Abstract: 395 De dicto assarto. Memorandum of a writ from the representative of the justice of the forest this side of Trent to Rog. son of John forester of Shropshire ordering him to take pledges from the abbot that he would appear before the said justice to answer for the waste he had caused in the wood of Hadnall. The abbot found the pledges and the wood was set free on 3 Feb. 1301. This writ preceded the forest perambulations prior to Edward I's confirmation of the Charter of the Forest on 14 Feb. 1301. Although there is some confusion, the writ must have been dated 24 Jan. 1300. The perambulations seem to have taken place in June 1300 (P.R.O., C 47-12-10) and the date 3 Feb. 1301 must refer to the disafforestation of the wood which was confirmed later by the king. Abstract: 1. THE MARSH Because lands in the Marsh are endangered through lack of repair of banks and sewers there, and especially through the obstruction of a sewer called le Flete, Thomas Burnham and Ralph Friskney are appointed to view them and determine who is responsible for repair, and to distrain in proportion to the amount of land held. The sheriff is to summon jurors for an enquiry. (Etcetera in this enrolment represents the standard formulae for setting such an enquiry in motion.) Burnham and Friskney each appear on several other occasions in the next few years as commissioners of sewers for various parts of the Marsh- cf. Imbanking, 155. Abstract: 153 Agreement in the form of a chirograph between John of Lincoln abbot of Dale and the canons and Hugo de Haregreve about the agistment and common of pasture in the "holm" of Alvaston and about the common of pasture in Stokwellflat. Hugo quitclaims all his right to agistment in the "holm" but retains his common of pasture there at the rate of six beasts for every bovate of fme tenement which he holds or will acquire in demesne. The canons may enclose Stokwellflat and hold it in severalty, but if the en-closure is inadequate and Hugo's cattle enter therein, he is to have them back freely.
