180—182. — Aus der ausfuhrlichen Erzahlung iiber 8* 116 Klosters behaupten, oder Allode,
wie der Verklagte angiebt. Beide Parteien erbieten sich zum Beweise (uterque — ido- neam
probationem offerebat). Die Ministerialen des Stifts entscheiden, dass Klager beweisen
solle: probationem in- cumbere, qui tilulum legalis beneficii suo litigalori oppo- suerat.
Verklagter zieht das Urtheil an das koniglichc Ge- richt, welches aber findet, dass die
